Day 3 of the ‪#‎pohakuloatrial‬ still on the stand with Russell Tsuji. The DLNR keeps trying to say they might have inspected Pōhakuloa sometime in 1994, because there is a blank form from that year. Seriously I think the only thing filled out in the form is the year 1994. It's embarrassing. Frankel says 'you don't know how many acres were inspected, in fact you don't even know if an inspection took place!' And even with the only time they ever bothered to inspect, the 1984 inspection, it doesn't make any mention of whether the inspector considered or assessed compliance with paragraphs 9 or 14 of the lease. Mr. Tsuji says he ought to have since that was the whole point. Why would he drive half a day? Which makes me wonder if that means he only left himself the other half a day to inspect 23,000 acres or what. Does it say where he went- NO. If he was looking for ordnance on the ground- NO. Or how long it lasted? -NO. When Tsuji is asked if he has seen spent ammo on the ground he is reluctant to admit he's seen shells.
