As an observer for the last 3 days of the ‪#‎pohakuloatrial‬ I feel like David Frankel did a pretty good job of proving that the State did nothing. Unless you count looking the other way as something. Despite the challenges of proving a negative I think the state had a much harder time proving that they did anything at all. So the rest of Tsuji's cross examination was their attempt to prove that the DLNR did some stuff, although it came way too late. But I guess at least it came. It certainly wouldn't have if these 2 Kupuna hadn't brought this lawsuit, so anyone who cares about Pōhakuloa owes them a big mahalo. The state says the cars are gone but I suspect there's a chance they could've just moved them over to the federal jurisdiction lands where they are able to give even less of a... They supposedly have also put in for funding to clean up the spent artillery dump (that or the bazooka range I can't remember) sometime in 2016. Which we can agree is slightly better than nothing. I think Frankel did the job of proving the negative. He showed document after document that the DLNR received over the years alerting them to trouble at Pōhakula and they did nothing. Every time. On Redirect Frankel brought up the Military Training Area Clearing Sheets that the DLNR knew the army garrison had, but never requested them to be provided. Also there was a request re: landfills on state land that reported the observation of possible UXO, that the DLNR just ignored, never following up to see if they bothered to clean it up.
